DMCA Policy (Digital Millennium Copyright Act)

FOTBO.AI

Podaon SIA ("FOTBO.AI") respects the intellectual property rights of others and requires the same from its Clients.

If you believe that your copyright is being infringed by content hosted on websites created using the FOTBO.AI Platform, or by AI Output generated by the Platform, please send an infringement notice to [email protected].

FOTBO.AI is committed to handling copyright infringement complaints responsibly and in accordance with applicable law. In circumstances where the Digital Millennium Copyright Act ("DMCA") applies, our policy is to process all valid notices of alleged copyright infringement promptly.

Please note that submitting a DMCA notice initiates a statutory legal process, and we will forward your complete notice, including your contact information, to the relevant FOTBO.AI Client.

In most cases, FOTBO.AI does not have access to content created by Clients through the Platform and does not control Client Data, including AI Output hosted on Client subdomains or custom domains. Accordingly, upon receipt of a valid DMCA notice, FOTBO.AI will forward your notice to the relevant Client and require a timely and adequate response. You may also send a DMCA notice directly to the FOTBO.AI Client if their contact details are available.

DMCA notices submitted to FOTBO.AI must relate to specific content hosted on websites created by Clients using the Platform. Claims that the underlying AI models used by the Platform were trained on copyrighted materials do not fall within the content takedown procedure described in this policy and are reviewed by FOTBO.AI separately in accordance with applicable law.

Upon receipt of a valid DMCA notice concerning content hosted on a FOTBO.AI subdomain, FOTBO.AI may restrict access to, block, or remove the specific Client project or subdomain without needing to suspend or delete the Client’s entire account.

If content is hosted by the Client on a custom domain, FOTBO.AI may have limited technical ability to remove such content directly. In that case, FOTBO.AI will forward the notice to the Client and require the Client to resolve the infringement independently within a reasonable period.

Please ensure that your notice contains all of the following information:

  • A physical or electronic signature of a person authorized to act on behalf of the owner of the exclusive right that is allegedly infringed;
  • Identification of the copyrighted works claimed to have been infringed;
  • Identification of the material that is claimed to be infringing and that must be removed or access to which must be disabled, as well as the specific URLs, including websites created on the FOTBO.AI Platform, where the material is located;
  • Information sufficient for FOTBO.AI or its Client to contact you, such as an address, telephone number, and email address;
  • A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;
  • A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.

Without this information, we will not be able to take timely action on your request.

Section 512(f) of the DMCA states that any person who knowingly materially misrepresents in a DMCA notice that content is infringing is liable for damages, including costs and attorney’s fees incurred by the alleged infringer. If you are not sure whether you have a valid copyright infringement claim, please consult an attorney before submitting a DMCA notice.

DMCA Counter-Notice

If a Client or a Client’s user believes in good faith that a copyright infringement notice was mistakenly submitted against them, the DMCA permits them to send us a counter-notice. If FOTBO.AI receives such a counter-notice, it will forward it to the original DMCA complainant.

Please ensure that your counter-notice includes all of the following:

  • Your physical or electronic signature;
  • Identification of the material identified as infringing in the original DMCA notice and the location where the material appeared;
  • A statement under penalty of perjury that you have a good-faith belief that the request to remove the material resulted from mistake or misidentification of the material;
  • Your name, address, and telephone number, as well as a statement that you consent to the jurisdiction of the competent court at the registered address of FOTBO.AI (Latvia), and that you will accept service of process from the person who provided the original DMCA notice or an agent of that person.

Repeat Infringer Policy

FOTBO.AI has adopted and reasonably implemented a policy that provides, in appropriate circumstances, for termination of Client accounts that repeatedly infringe the intellectual property rights of third parties.
